These Terms of Service ("Terms") govern your access to and use of Chatdrift's website, dashboard, embeddable widget, and related services (together, the "Service"), operated by Chatdrift ("Chatdrift," "we," "us," or "our"). By creating an account, accessing your dashboard, or otherwise using the Service, you agree to these Terms. If you're using Chatdrift on behalf of an organization, you're agreeing on that organization's behalf, and you confirm you have the authority to do so.
2. Description of the Service
Chatdrift provides AI-powered customer conversation tools, including AI support agents, a shared team inbox, an embeddable widget, workflow automation, forms, and help documentation. We may add, change, or remove features over time as we continue developing the Service.
3. Accounts and Eligibility
You need an account to use most of Chatdrift's features. You're responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information when creating an account and keep it up to date. You must be legally able to enter into a binding contract to use Chatdrift, and you're responsible for ensuring your use of the Service complies with any laws or industry rules that apply to your business.
4. Acceptable Use
You agree to use Chatdrift responsibly and lawfully. You may not use the Service to:
Send spam, malware, or content that violates applicable law
Harass, defraud, or deceive others
Attempt to gain unauthorized access to Chatdrift systems, other accounts, or connected integrations
Reverse-engineer, scrape, or resell the Service without our written permission
Use the Service to train a competing AI product on behalf of a third party
Upload content you don't have the right to share, including content that infringes someone else's intellectual property
5. Subscriptions, Billing, and Cancellation
Chatdrift offers a free plan and several paid subscription plans, billed monthly or annually. Paid subscriptions are processed through Stripe, our payment processor; by subscribing, you authorize us (via Stripe) to charge your chosen payment method on a recurring basis until you cancel. Prices, plan limits, and features are described on our pricing page and may change with reasonable notice for future billing periods. You can cancel your subscription at any time from your account settings; cancellation takes effect at the end of your current billing period, and we don't provide refunds for partial billing periods except where required by law.
6. AI-Generated Content
Chatdrift's AI agents generate responses based on the instructions, documentation, and data you provide, using third-party AI models. AI-generated content can be incomplete, out of date, or simply wrong — you're responsible for reviewing and configuring your AI agents appropriately for your use case, and for supervising the conversations your agents have with your customers. Chatdrift does not guarantee the accuracy, completeness, or suitability of any AI-generated response, and you should not rely on AI-generated content for decisions where an incorrect answer could cause harm without human review.
7. Your Content and Intellectual Property
You retain ownership of the content you upload to Chatdrift — your help docs, custom instructions, contact records, and conversation data ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to provide and improve the Service to you. We retain all rights to the Chatdrift platform itself, including its software, design, and trademarks; nothing in these Terms transfers ownership of Chatdrift to you.
8. Third-Party Integrations and Services
Chatdrift can connect to third-party platforms and services you choose to integrate with your workspace. Your use of any connected third-party service is subject to that provider's own terms and privacy policy, and we aren't responsible for how third-party services handle your data once you've connected them.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that the Service will be uninterrupted, error-free, or completely secure.
10. Limitation of Liability
To the maximum extent permitted by law, Chatdrift and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim arose.
11. Termination
You may stop using Chatdrift and close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, if required by law, or if we discontinue the Service, with notice where reasonably possible. Sections of these Terms that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.
12. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Service will be handled in the courts located in that jurisdiction, unless otherwise required by applicable law.
13. Changes to These Terms
We may update these Terms from time to time as Chatdrift evolves. If we make material changes, we'll update the effective date above and, where appropriate, notify you directly. Continuing to use the Service after an update means you accept the revised Terms.
